These policies form part of the terms governing purchases from Fishman’s Pens. Mandatory consumer rights under applicable law are not limited by this policy.

Who controls your information

The controller of personal information collected through this store is Amihai Fishman, trading as Fishman’s Pens, Israeli business / identification number 212919450, 6 Negba Street, Zichron Yaakov 3091607, Israel.

Information collected

Depending on how a person uses the website or communicates with Fishman’s Pens, the following information may be collected:

  • Identity and contact information, such as name, email address, telephone number, billing address and shipping address.
  • Order information, including products ordered, order value, delivery details, returns, refunds and transaction history.
  • Custom-order information, including selected materials, dimensions, nib, finish, engraving and other specifications, together with related correspondence.
  • Payment and transaction information supplied by PayPal or Shopify, such as payment status, transaction identifier and limited billing information. Fishman’s Pens does not receive or store a customer’s complete payment-card credentials.
  • Communications sent by email, the website contact form or telephone.
  • Technical and usage information collected through Shopify, such as IP address, device, browser, approximate location, pages visited and cookie identifiers.

Shopify’s passwordless customer-account system is available only for secure order access, cancellation and return requests. The ordinary account icon may be hidden from the storefront, and an account is not required to browse the website or submit a custom-order inquiry. Fishman’s Pens does not currently operate a mailing list, send abandoned-checkout marketing, use SMS or WhatsApp marketing, or use a separate Google Analytics installation, Meta/Facebook Pixel, advertising pixel, review application or live-chat application.

Why information is used

  • To take steps requested before a purchase, process orders and payments, produce custom items, arrange tracked delivery, provide customer service, handle cancellations, returns and refunds, and perform the sales contract.
  • To issue receipts and comply with accounting, tax, consumer-protection and other legal obligations.
  • To prevent fraud, protect the website, maintain records, resolve disputes and enforce lawful terms.
  • To operate and improve the website using essential functionality and ordinary Shopify analytics.
  • For any optional non-essential cookie or other use that requires consent, only after the required consent has been obtained.

Where EEA or UK data-protection law applies, these activities are based, as appropriate, on performance of a contract or steps before a contract, compliance with legal obligations, legitimate interests in operating and securing the business, or consent.

Whether information must be provided

Providing personal information is generally voluntary. However, Fishman’s Pens cannot process an order, issue a payment request, create a receipt, arrange delivery or respond properly to a request unless the information needed for that purpose is supplied.

Service providers and recipients

Personal information may be shared only as reasonably necessary with:

  • Shopify, which hosts the storefront, checkout and order-administration systems and provides ordinary store analytics.
  • PayPal, which processes payments.
  • Morning (Green Invoice / חשבונית ירוקה), which is used for receipts, invoices and accounting records.
  • Israel Post, DHL Express and other carriers used to provide tracked delivery and handle shipping inquiries.
  • Google or Gmail services used for business email and customer correspondence.
  • Professional advisers, insurers, authorities, courts or law-enforcement bodies when reasonably necessary or legally required.

Fishman’s Pens does not sell personal information and does not independently use it for targeted advertising.

Cookies and analytics

The website uses cookies and similar technologies required for core functions such as security, language and cart preferences, checkout, payment and fraud prevention. Shopify may also provide ordinary analytics concerning website use.

Where consent is required, non-essential cookies will not be used until the visitor makes the relevant choice through the cookie banner or privacy controls. Visitors may change available privacy choices through the store’s privacy controls and may also manage cookies through their browser.

International processing

Shopify, PayPal, Google, carriers and other service providers may process information outside Israel or outside the customer’s country. Where required, appropriate contractual or legal transfer safeguards are used by the relevant provider.

Retention

Personal information is retained only for as long as reasonably needed to fulfil orders, provide support, comply with tax, accounting and legal duties, protect legal rights and resolve disputes. Custom-order specifications and correspondence are not intentionally retained longer than needed for those purposes.

Security

Fishman’s Pens uses reasonable administrative and technical measures and relies on established service providers to protect personal information. No online system is completely secure, and customers should not send sensitive payment credentials through ordinary email or contact forms.

Your rights

Subject to applicable law, a person may request access to personal information, correction of inaccurate information, deletion, restriction, objection, or a portable copy. A person may also withdraw consent where processing is based on consent and may complain to the competent privacy or data-protection authority.

Under Israeli law, data subjects may have rights of access and correction in relation to information held about them. EEA and UK residents may have the additional rights described above under their local law.

Children

The store is not directed to children, and Fishman’s Pens does not knowingly collect personal information from children who cannot lawfully enter into a purchase without the involvement of a parent or guardian.

Changes to this policy

This policy may be updated to reflect legal, technical or operational changes. The revised version will be published on the website with an updated date, and additional notice will be given where required by law.
