Terms of Purchase and Website Use
These policies form part of the terms governing purchases from Fishman’s Pens. Mandatory consumer rights under applicable law are not limited by this policy.

Business and scope
These terms govern use of fishmanspens.com and purchases from Fishman’s Pens, operated by Amihai Fishman, Israeli exempt dealer (עוסק פטור), business / identification number 212919450, 6 Negba Street, Zichron Yaakov 3091607, Israel.
By placing an order or paying a custom-order invoice, the customer agrees to these terms and the applicable shipping, return and privacy policies. Nothing in these terms limits mandatory consumer rights.
Products and handmade variation
Fishman’s Pens currently offers handmade fountain pens and may later offer other writing instruments or related items.
A ready-made listing represents the exact individual item shown unless the listing expressly states otherwise. Because the products are handmade and often incorporate natural materials, minor variations in grain, colour, pattern, texture, dimensions and finish are normal. Natural ageing or colour change in wood or ebonite is not by itself a defect, provided the item materially matches its description.
Product photographs and descriptions are prepared carefully, but screen settings and lighting can affect the appearance of colour.
Prices, tax, shipping and import charges
Prices are shown in the currency displayed by the store. Amihai Fishman is registered in Israel as an exempt dealer (עוסק פטור), and Israeli VAT is not charged.
Standard tracked shipping is included in the displayed price for destinations offered at checkout. International import VAT, customs duties, brokerage fees and local handling charges are the customer’s responsibility.
Payment and order acceptance
Payment is currently accepted through PayPal. The customer is charged immediately when checkout payment is completed.
An online order is subject to acceptance by Fishman’s Pens. Fishman’s Pens may cancel an order because of an inventory error, an obvious pricing or description error, suspected fraud, a failed or reversed payment, legal or carrier restrictions, or an inability to ship reliably to the destination. If Fishman’s Pens cancels an order after payment, all amounts paid will be refunded.
Custom-order process
A customer seeking a custom pen submits the available specifications through the website selector. Fishman’s Pens reviews the request and may accept it, reject it, or request clarification.
When a request is accepted, Fishman’s Pens creates a Shopify draft order and sends a dedicated invoice or secure checkout link containing the agreed specifications and total price, including standard tracked shipping.
Custom orders are paid in full in advance through PayPal. Production begins immediately after payment and normally takes 4–8 weeks. The pen will be dispatched no later than eight weeks after payment unless the customer expressly agrees in writing to a later date.
By completing payment, the customer confirms that the materials, dimensions, nib, finish, engraving and other options shown in the payment request are correct.
A non-engraved custom order may be cancelled for a full refund at any time before dispatch and remains eligible for the 14-day return policy after delivery.
An engraved or permanently personalised order may be cancelled for change of mind until engraving work begins. Once engraving work begins, the restriction applies to the entire item. This does not affect rights where the item is defective, damaged, incorrect or does not match the approved specifications.
Dispatch, delivery, cancellations and returns
Dispatch, delivery, cancellation, return and refund arrangements are governed by the Shipping and Delivery Policy and the Cancellations, Returns and Refunds Policy, which form part of these terms.
Proper use and care
Customers should use, fill, clean and store writing instruments with reasonable care and follow any instructions supplied. Damage caused by impact, crushing, excessive pressure on the nib, unsuitable chemicals, improper disassembly, misuse or ordinary wear is not treated as a manufacturing defect, except where applicable law provides otherwise.
Fishman’s Pens does not provide a separate voluntary commercial warranty. Mandatory rights concerning faulty or non-conforming goods remain fully applicable.
Website use and intellectual property
Website text, photographs, designs, logos and other original content are owned by Fishman’s Pens or used with permission. They may not be copied, republished, sold or used commercially without written permission, except as permitted by law.
The website may be used only for lawful purposes. Attempts to interfere with security, checkout, pricing, availability or operation of the website are prohibited.
Availability and changes
Fishman’s Pens may update products, prices, website content and these terms. A change does not alter an order already accepted unless the customer agrees or the change is required by law.
Liability and mandatory rights
To the maximum extent permitted by law, Fishman’s Pens is not responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was made. Nothing excludes liability that cannot lawfully be excluded, or limits rights concerning defective, unsafe, misdescribed or undelivered goods.
Governing law and disputes
These terms are governed principally by the laws of the State of Israel. The competent courts in Israel will have jurisdiction, subject always to any mandatory consumer right to bring a claim or rely on protections in the customer’s country of residence.
Customers are encouraged to contact Fishman’s Pens first so that a complaint can be considered and, where possible, resolved directly.
Languages
The English and Hebrew versions are intended to be equally authoritative and to express the same commercial commitments. If a difference arises, the versions should be interpreted consistently with each other and with the mandatory law that applies to the customer.
